AU NOM DU PEUPLE FRANCAIS

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :

Attendu que, par acte déposé au greffe de la Cour de Cassation le 8 décembre 2003, Me Choucroy, avocat à la Cour de Cassation, a déclaré, au nom de M. X..., se désister du pourvoi formé par lui contre un arrêt rendu le 23 avril 2002 par la cour d'appel de Montpellier, au profit de la SCI Littoral Catalan investissement Marina Atlantide, de la société Axa France IARD et MM. Y... et Z... ;

Que ce désistement, intervenu après le dépôt du rapport, doit, aux termes de l'article 1026 du nouveau Code de procédure civile, être constaté par arrêt ;

PAR CES MOTIFS :

DONNE acte à M. X... du désistement de son pourvoi ;

Condamne M. X... aux dépens ;

Vu l'article 700 du nouveau Code de procédure civile, condamne M. X... à payer à la SCI Littoral Catalan investissement Marina Atlantide la somme de 1 900 euros et à la société Axa France IARD la somme de 1 900 euros ;

Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du deux mars deux mille quatre.
