Tenant Appeal on Lease Termination After Partial Property Destruction
Synthèse Legislator
Généré par l'IAThe appeal concerned a tenant challenging a lower court decision following a flood in 1995, where the tenant alleged partial destruction of the leased property should lead to lease termination under the relevant civil code article. The high court rejected the appeal because the trial court had not established a total destruction of the property, meaning the appellant's argument regarding partial destruction was both factually unsubstantiated in the initial proceedings and procedurally inadmissible as a new mixed question of fact and law raised for the first time on appeal.

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, ci-après annexé :
Attendu, d'une part, que le Tribunal n'ayant pas constaté qu'à la suite de l'inondation du 19 juin 1995, la chose louée avait été détruite en totalité, le moyen manque en fait ;
Attendu, d'autre part, que Mme X... n'ayant pas soutenu devant le Tribunal que l'appartement avait été détruit partiellement et que le bail devait être résilié sur le fondement de l'article 1722 du Code civil, le moyen est nouveau, mélangé de fait et de droit, et, partant, irrecevable ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne Mme X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du vingt-quatre février deux mille quatre.
