Tenant's Security Deposit Deduction Without Joint Move-Out Inspection Report
Synthèse Legislator
Généré par l'IAIn a dispute regarding the return of a security deposit following a tenancy termination, the tenant sought to deduct the deposit amount from sums owed based on the absence of a jointly established move-out inspection report, as required by law. The Court of Cassation affirmed the lower court's ruling, reasoning that in the absence of a move-out inspection report established contradictorily by both parties and the explicit agreement of the lessor, the tenants could not automatically demand that the deposit amount be deducted from the sums they owed.

R E P U B L I Q U E F R A N C A I S E AU NOM DU PEUPLE FRANCAIS LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, ci-après annexé :
Attendu qu'aux termes du 2e alinéa, de l'article 3, de la loi du 6 juillet 1989 un état des lieux devant être établi contradictoirement par les parties lors de la restitution des clés, la cour d'appel a, sans ajouter une condition qu'il ne comporte pas à l'article 22 de la loi susvisée, ni violé le principe de la contradiction, exactement retenu qu'en l'absence d'un état des lieux et de l'accord exprès de la bailleresse, M. X... et Mme Y... ne pouvaient exiger que soit dores et déjà déduit le montant de la caution des sommes dont ils sont redevables ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... et Mme Y... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du premier avril deux mille trois.
