AU NOM DU PEUPLE FRANCAIS

LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :

Vu l'article 384 du nouveau Code de procédure civile ;

Attendu que par observation déposées au greffe le 5 mai 2003 Me Rouvière, avocat de l'ARC, a informé la Cour de Casation du décès, le 2 mai 2001, de Renée Borie, veuve X..., et demanderesse, et de la renonciation par ses héritiers et sa légataire universelle à sa succession ;

Attendu qu'en application du texte susvisé il y a extinction de l'instance ;

PAR CES MOTIFS :

Constate le DESSAISISSEMENT de la Cour ;

Laisse les dépens à la charge du Trésor public ;

Vu l'article 700 du nouveau Code de procédure civile, rejette la demande de l'association "ARC" ;

Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du neuf juillet deux mille trois.
