Jurisdictional Dispute Over Industrial Tribunal Competence and Mooted Appeal
Synthèse Legislator
Généré par l'IAA dispute arose wherein an employer appealed a decision by the industrial tribunal that both asserted its jurisdiction and granted relief to an employee, with the employer also lodging a separate appeal regarding the jurisdiction issue. Following a prior decision by the High Court to suspend judgment on the initial appeal pending a final ruling on jurisdiction, the Court of Appeal subsequently ruled that the industrial tribunal was incompetent, assigning jurisdiction to the social security tribunal; a subsequent High Court rejection of the appeal against the Court of Appeal's jurisdiction finding renders the initial appeal against the industrial tribunal's merits decision moot, leading the High Court to declare no need to rule on the appeal concerning the initial judgment.

LA COUR DE CASSATION, CHAMBRE SOCIALE, a rendu l'arrêt suivant :
Attendu que la SNCF, dans le litige l'opposant à M. X..., s'est pourvue en cassation contre le jugement rendu le 15 décembre 1997 par le conseil de prud'hommes de Nice qui s'était déclaré compétent et avait accueilli au fond la demande du salarié qui n'excédait pas le taux de compétence en dernier ressort de la juridiction prud'homale ; que la SNCF ayant également formé un appel du chef de la compétence, la Cour de Cassation, par un précédent arrêt prononcé le 19 avril 2000, avait sursis à statuer jusqu'à ce qu'une décision irrévocable intervienne sur la compétence ; que sur l'appel de la SNCF, la cour d'appel a déclaré la juridiction prud'homale incompétente au profit du tribunal des affaires de sécurité sociale et que, par arrêt du 4 mars 2003, la Cour de Cassation a rejeté le pourvoi contre l'arrêt de la cour d'appel ; qu'il n'y a pas lieu dès lors de statuer sur le pourvoi formé contre le jugement du conseil de prud'hommes ;
PAR CES MOTIFS :
Dit n'y avoir lieu à statuer ;
Condamne la Société nationale des chemins de fer français aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Chambre sociale, et prononcé par le président en son audience publique du dix juin deux mille trois.
