Enforcement of Astreinte Upheld Despite Nullity Claim Regarding Assignment
Synthèse Legislator
Généré par l'IAThe court upheld the decision to enforce a penalty (astreinte) based on a 1994 judgment, rejecting the appeal which argued that the assignment initiating the enforcement procedure was null. The Court of Cassation reasoned that the enforcement judge was bound by the terms of the original judgment, and that while there were two separate co-owner associations, a subsequent joint assembly decision authorized the common property manager to pursue the penalty against the appealing entity, which was foreign to the associations' functioning; furthermore, the imprecise naming in the assignment was deemed a necessary interpretation given the context, thereby upholding the lower court's decision to reject the nullity claim and liquidate the penalty without violating the adversarial principle.

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, ci-après annexé :
Attendu qu'ayant relevé, à bon droit, que le dispositif de l'arrêt du 13 juin 1994, servant de fondement aux poursuites, s'imposait au juge de l'exécution sans possibilité de modification, ni de suspension et que s'il existait deux syndicats de copropriétaires, le syndicat des bâtiments AB et le syndicat du bâtiment C, il ressortait du procès-verbal de l'assemblée générale commune du 17 octobre 1996 que les copropriétaires de ces deux syndicats et des trois bâtiments avaient donné mandat au syndic commun d'entreprendre la procédure en liquidation d'astreinte par une décision que la société civile immobilière Jagimmo, étrangère au fonctionnement de ces syndicats de copropriétaires, ne pouvait contester et retenu par une interprétation nécessaire que l'imprécision des termes de l'assignation en liquidation d'astreinte rendait nécessaire, que la procédure avait été introduite à la requête des deux syndicats de copropriétaires, sous la dénomination "syndicat des copropriétaires de deux bâtiments A, B, C, ...", représentés par leur syndic commun, dûment autorisé, la cour d'appel qui a écarté la nullité de l'assignation et liquidé l'astreinte prononcée par arrêt du 13 juin 1994, a, sans violer le principe de la contradiction, légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne la SCI Jagimmo aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du seize septembre deux mille trois.
