Action Negatory of French Nationality vs. Statute of Limitations Challenge
Synthèse Legislator
Généré par l'IAAn individual born in the Comoros challenged a ruling that confirmed his foreign status, arguing that the public prosecutor's action was time-barred because the alleged falsity of his mother's declaration of French nationality was discovered years prior, violating a specific article of the Civil Code regarding challenges to nationality declarations. The Court of Cassation rejected the appeal, reasoning that the public prosecutor was not challenging the registration of the declaration itself, but rather exercising the action negatory of French nationality against the individual, which is based on a different article of the Civil Code that imposes no statute of limitations on such an action.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique :
Attendu que M. X..., né aux Comores vers 1966, reproche à l'arrêt confirmatif attaqué (Paris, 16 novembre 1999) d'avoir, sur l'action du ministère public, constaté son extranéité, alors, selon le moyen, que la fausseté de la déclaration de nationalité française de sa mère ayant été découverte le 23 novembre 1989, la validité et l'effet collectif de cette déclaration ne pouvaient plus être contestés par le ministère public le 31 janvier 1995, de sorte que la cour d'appel a violé l'article 26-4, alinéa 2, du Code civil ;
Mais attendu que les juges du fond ont décidé exactement que le ministère public ne contestait pas l'enregistrement d'une déclaration de nationalité, par ailleurs non souscrite par la mère de M. X..., mais exerçait l'action négatoire de nationalité française à l'égard de celui-ci, laquelle est fondée sur l'article 29-3 du Code civil qui ne la soumet à aucune prescription ; d'où il suit que le moyen est sans fondement ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du premier juillet deux mille trois.
