Appeal Inadmissibility Regarding Rural Lease Termination Following Related Annulments
Synthèse Legislator
Généré par l'IAA party appealed several appellate court decisions concerning the termination of a rural lease, specifically citing three judgments: one from March 9, 2000, ordering termination, and two others from June 22, 2000, and February 1, 2001, which respectively annulled a lease amendment and rejected a termination request. The Court of Cassation declared the appeal inadmissible because the two later appellate decisions upon which the appeal was partly founded had just been annulled by a separate ruling of the same day, leaving only the initial termination order of March 9, 2000, standing, which made the basis for the current appeal incoherent or resolved against the appellant.

Généré par l'IAThe court explicitly declared the appeal inadmissible, which is the final ruling on the case's substance/procedure.
Cited in the dispositive to rule on the request for costs under Article 700.
This implicitly relies on the procedural rules governing costs (often Art. 750 CPC in such contexts, but only the explicit condemnation is listed here, although usually, the specific cost provision like Art. 67 of the former CPC or equivalent would be cited alongside the condemnation; however, following the strict rule of citing only explicit citations, only the cost-related article 700 is explicitly cited as 'Vu'). Given the instruction to extract provisions *cited* in the dispositive, and only Article 700 is cited with 'Vu', we prioritize the explicit citations. The condemnation to costs itself is a resulting order.

LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique :
Attendu qu'invoquant la contrariété de l'arrêt de la cour d'appel de Toulouse du 9 mars 2000 ayant résilié le bail rural liant le GFA X... (GFA) et le GAEC de Rocheville, et des arrêts de la même cour d'appel du 22 juin 2000 et du 1er février 2001 ayant le premier, annulé un avenant au contrat de bail et le second, rejeté la demande de la résiliation du bail, le GFA s'est pourvu en cassation sur le fondement de l'article 618 du nouveau Code de procédure civile ;
Attendu, cependant, que les arrêts du 22 juin 2000 et 1er février 2001 ayant été annulés par un arrêt de ce jour de la Cour de Cassation, l'arrêt du 9 mars 2000 subsiste seul ;
D'où il suit que le pourvoi n'est pas recevable ;
PAR CES MOTIFS :
Déclare le pourvoi IRRECEVABLE ;
Condamne Mme X..., ès qualités, aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, rejette la demande du GFA X... ;
Ainsi fait et jugé par la Cour de Cassation, Deuxième chambre civile, et prononcé par le président en son audience publique du trente avril deux mille trois.
