LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :

Vu les articles L. 131-2 et L. 131-3 du Code de l'organisation judiciaire ;

Ordonne le renvoi devant l'assemblée plénière du pourvoi n° W 02-30.157 formé par le Directeur régional des affaires sanitaires et sociales du Pays de Loire contre l'arrêt n° 714 de la cour d'appel de Poitiers du 4 décembre 2001 ;

Réserve les dépens ;

Ainsi fait et jugé par la Cour de Cassation, Deuxième chambre civile, et prononcé par le président en son audience publique du premier juillet deux mille trois.
