Cassation of Subsequent Judgment Due to Annulment of Preceding Judgment
Synthèse Legislator
Généré par l'IAThe Court of Cassation addressed a situation where a subsequent judgment, rendered on July 27, 2000, followed a judgment from July 18, 2000, which was being appealed. Based on Article 625, paragraph 2, of the new Code of Civil Procedure, the Court reasoned that the cassation of the earlier judgment necessarily leads to the annulment of the subsequent judgment that resulted from it. Therefore, the Court confirmed the complete annulment of the July 27, 2000 judgment, ordering the costs against the public office of development and construction, and mandated the recording of this decision alongside the annulled judgment.
