Spousal Contribution Calculation and Timing in Divorce Appeal
Synthèse Legislator
Généré par l'IAThe case involved a wife who sued her husband for divorce based on fault, following their marriage without a prenuptial agreement, where the initial judgment dismissed the divorce claim but ordered the husband to pay a monthly contribution towards marital expenses. The appellate court partially overturned this, reducing the required contribution, and the husband appealed to the highest court, arguing the appellate court violated the relevant civil code article concerning the timing and calculation of the spousal contribution. The high court dismissed the appeal because the appellate court, acting within its sovereign power, determined the contribution amount based on the evolution of the parties' resources and expenses and did not incorrectly set the start date for the obligation.

Attendu que les époux X... ont contracté mariage le 8 décembre 1967 sans contrat préalable, que le 13 juillet 1995, Mme X... a assigné son mari en divorce pour faute ; qu'un jugement du tribunal de grande instance de Sarreguemines l'a déboutée de sa demande et a fixé à 2 200 francs par mois avec indexation, la contribution aux charges du mariage que devrait lui verser M. X... ; que ce dernier a interjeté appel pour voir supprimer la contribution mise à sa charge, tandis que Mme X... a formé appel incident en sollicitant le prononcé du divorce aux torts de son mari et à titre subsidiaire la confirmation du jugement ; que l'arrêt attaqué (Metz, 14 septembre 1999) a réformé partiellement la décision des premiers juges en réduisant à 1 000 francs par mois avec indexation, la contribution mise à la charge du mari ;
Attendu que la cour d'appel a, d'une part, dans l'exercice de son pouvoir souverain, fixé la contribution pour tenir compte de l'évolution des ressources et des charges des parties, et, d'autre part, n'a pas décidé que la contribution serait due à compter du 1er décembre 1998 ;
D'où il suit que le moyen, tiré d'une double violation de l'article 258 du Code civil, manque en fait en ses deux branches ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, rejette la demande de M. X... ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du six mai deux mille trois.
