Client Fee Dispute and Attorney Billing Rate Challenge
Synthèse Legislator
Généré par l'IAThe First Civil Chamber of the Court of Cassation rejected an appeal concerning the fixing of attorneys' fees owed by a client to a professional civil society of lawyers, which the First President of the Paris Court of Appeal had set at 174,000 francs. The court reasoned that the client could not claim a lack of information regarding the fee structure because the lawyer had sent three invoices calculating fees based on an hourly rate of 1,345 francs, and the first invoice had been paid without reservation, legally justifying the fee determination; moreover, the final argument attempting to contest the sovereign assessment of the fee amount based on the diligence performed and the difficulty of the case was deemed inadmissible.

Attendu que, statuant sur les honoraires dus à la société civile professionnelle d'avocats Moquet-Borde (la SCP) par la société Marina projects investissement (MPI), l'ordonnance attaquée (premier président Paris, 26 juin 2001) les a fixés à 174 000 francs ;
Attendu, d'abord, qu'ayant constaté que la SCP avait adressé à sa cliente trois factures d'honoraires faisant ressortir leur fixation selon un taux horaire de 1 345 francs n'ayant fait l'objet d'aucune contestation sur ce mode de calcul puisque la première facture avait été acquittée sans réserves, le premier président a légalement justifié sa décision de considérer que la société MPI ne saurait sérieusement alléguer un manque d'information à cet égard, peu important le motif justement critiqué par la deuxième branche du moyen, mais surabondant ;
que, sous couvert de griefs non fondés, le moyen ne tend, en sa dernière branche, qu'à remettre en discussion devant la Cour de Cassation l'appréciation souveraine faite par le premier président du montant des honoraires litigieux, en considération des diligences de l'avocat et de la difficulté de l'affaire ; que le moyen, non fondé en sa première branche et inopérant en sa deuxième, ne peut être accueilli en sa troisième ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne la société Marina international projects aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du neuf juillet deux mille trois.
