Lease Termination for Unauthorized Basement Expansion
Synthèse Legislator
Généré par l'IAThe dispute centered on the alleged unauthorized removal of a staircase and subsequent expansion of a basement by a tenant, leading to the termination of the lease. The Court of Cassation upheld the lower court's decision, which had rejected the tenant's arguments, finding that the testimony offered to prove the landlord's acceptance of the modifications was imprecise and failed to establish that the manager of the property-holding entity had consented to the alterations, thus legally justifying the finding that the lease violation occurred and the lease was terminated as of May 21, 1992.

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, ci-après annexé :
Attendu qu'ayant retenu que le témoignage de M. Jean-Louis X... était imprécis et ne permettait pas de tenir pour vrai que M. Y..., ès qualités de gérant de la société civile immobilière (SCI) bailleresse avait accepté l'enlèvement de l'escalier et l'agrandissement du sous-sol qui avait suivi et constaté en conséquence que l'infraction était établie et le bail résilié à compter du 21 mai 1992, la cour d'appel qui n'était pas tenue de procéder à une recherche que ses constatations rendaient inopérante, ni à une recherche qui n'était pas demandée, a légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne la société Club House aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, condamne la société Club House à payer à la SCI Mojepie la somme de 1 900 euros ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du dix-sept décembre deux mille deux.
