Creditor's Liquidator Capacity on Appeal vs. Guarantor's Objection
Synthèse Legislator
Généré par l'IAIn a dispute where a creditor sought to enforce a guarantee following the declaration of the creditor's amicable liquidation and the subsequent intervention of its liquidator, the guarantor raised an objection to the admissibility of the claim. The appellate court rejected this objection by ruling that since the companies had not filed a cross-appeal, it was incumbent upon the guarantor, if disputing their legal status, to sue the parties they considered properly qualified to defend on appeal. The Court of Cassation quashed the decision, finding that the appellate court had unlawfully added a condition to the law by requiring the guarantor to initiate a separate action against the alleged correct parties rather than allowing the objection to admissibility based on the intervening liquidator's capacity, thereby violating the relevant procedural article.

LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le deuxième moyen, pris en sa deuxième branche :
Vu l'article 123 du nouveau Code de procédure civile ;
Attendu que la société Soderag a poursuivi, contre Mme X..., l'exécution du cautionnement qu'elle avait consenti pour garantir le remboursement d'un prêt ; qu'en cause d'appel, la société Soderag ayant déclaré être en liquidation amiable et la société Sofideg étant intervenue à l'instance comme son liquidateur, la caution a opposé l'irrecevabilité de la demande ;
Attendu que pour écarter cette fin de non-recevoir, l'arrêt attaqué retient que ces sociétés n'avaient pas formé appel incident et qu'il appartenait à la caution, si elle contestait leur qualité, d'assigner les personnes qu'elle estimait qualifiées pour défendre en appel ;
Qu'en ajoutant à la loi une condition qu'elle ne comporte pas, la cour d'appel a violé le texte susvisé ;
PAR CES MOTIFS, et sans qu'il y ait lieu de statuer sur les autres griefs du pourvoi :
CASSE ET ANNULE, dans toutes ses dispositions, l'arrêt rendu le 3 avril 2000, entre les parties, par la cour d'appel de Fort-de-France ; remet, en conséquence, la cause et les parties dans l'état où elles se trouvaient avant ledit arrêt et, pour être fait droit, les renvoie devant la cour d'appel de Basse-Terre ;
Condamne la société Soderag et son liquidateur aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, rejette la demande des sociétés Soderag et Sofideg, condamne la société Soderag à payer à Mme X..., la somme de 1 500 euros ;
Dit que sur les diligences du procureur général près la Cour de Cassation, le présent arrêt sera transmis pour être transcrit en marge ou à la suite de l'arrêt cassé ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du vingt et un janvier deux mille trois.
