Receiver's Opposition to Judgment Overturned Following Prior Appellate Ruling Nullification
Synthèse Legislator
Généré par l'IAA receiver appointed for a company sought to overturn a lower court decision that dismissed its third-party opposition to an earlier appellate ruling which had ordered the company and another entity to pay a substantial sum plus contractually agreed interest to a third party. The Court of Cassation determined that the ruling currently under appeal was necessarily dependent on the prior appellate judgment, which the Court had just overturned in a separate decision for having improperly condemned the parties to pay the principal sum and accrued interest with capitalization. Consequently, as the underlying decision was voided, the Court ruled that there was no need to rule on the appeal against the dismissal of the opposition, effectively annulling the appealed decision by consequence.

LA COUR DE CASSATION, CHAMBRE COMMERCIALE, FINANCIERE ET ECONOMIQUE, a rendu l'arrêt suivant :
Attendu que la SCP Laureau-Jeannerot, commissaire à l'exécution du plan de la société Gipsi, demande la cassation de l'arrêt rendu le 27 avril 2001 par la cour d'appel de Paris qui a rejeté sa tierce-opposition contre un arrêt rendu le 29 juin 2000 par la même cour d'appel ;
Mais attendu que ce dernier arrêt a été cassé ce jour par arrêt n° 382 F-D en ce qu'il a condamné les sociétés Gipsi et CDR entreprises à payer à la société Hackers la somme de 1 300 098,04 francs avec intérêts contractuels au taux de 12,5 % à compter du 11 janvier 1993, outre la capitalisation des intérêts, et a rejeté leurs demandes ; d'où il suit que l'arrêt actuellement attaqué, qui s'y rattache par un lien de dépendance nécessaire, s'est trouvé annulé par voie de conséquence ;
PAR CES MOTIFS :
DIT n'y avoir lieu à statuer ;
Condamne les sociétés Gipsi, CDR entreprises et Hackers aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, rejette la demande de la société Hackers ;
Ainsi fait et jugé par la Cour de Cassation, Chambre commerciale, financière et économique, et prononcé par le président en son audience publique du quatre mars deux mille trois.
