Purchasers v. Seller and Manufacturer (Moldy Door Resolution)
Synthèse Legislator
Généré par l'IAPurchasers sued the seller and manufacturer after discovering mold on a recently purchased entrance door, leading to a judgment ordering the resolution of the sale. The manufacturer appealed, arguing the lower court failed to specify how the door did not conform to the order and that the noted defects were easily repairable, thus failing to legally justify the resolution under articles 1604 and 1184 of the Civil Code. The Court of Cassation rejected the appeal, reasoning that the lower court judges had sovereignly determined that the delivered door did not conform to the agreed-upon characteristics, making the ease of repair irrelevant and legally justifying the decision to rescind the sale.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique :
Attendu que, le 12 février 1998, les époux X... ont acheté, auprès de la société Meignen distribution une porte d'entrée, fabriquée par la société Portes Bel'M, au prix de 10 823,85 francs ; que, se plaignant de désordres, ils ont, après expertise judiciaire ordonnée en référé, assigné le vendeur et le fabricant ;
Attendu que la société Portes Bel'M fait grief au jugement attaqué (tribunal d'instance de Parthenay, 6 avril 2001) d'avoir, pour prononcer la résolution de la vente, retenu que le vendeur avait manqué à son obligation de délivrance en livrant une porte sur laquelle étaient apparues des traces de moisissures, sans dire en quoi la porte n'était pas conforme à la commande, mais en relevant seulement qu'elle présentait des défauts facilement réparables, de sorte que le Tribunal n'a pas légalement justifié sa décision au regard des articles 1604 et 1184 du Code civil ;
Mais attendu que les juges du fond ont souverainement constaté que la porte livrée n'était pas conforme aux caractéristiques convenues ; que dès lors, peu important que les défauts aient été facilement réparables, le Tribunal a légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne la société Portes Bel'M aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, condamne la société Porte Bel'M à payer aux époux X... la somme de 1 800 euros ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du quatorze janvier deux mille trois.
