Water Utility Bill Prescription Period Dispute
Synthèse Legislator
Généré par l'IAThe case involved an appeal against a lower court's decision that dismissed a company's 1998 claim for unpaid water bills from 1994, based on the two-year short prescription period applicable to merchants selling goods to non-merchants under Article 2272, paragraph 4, of the Civil Code. The appellant argued that this short prescription did not apply because the water supply contract was a service contract, not a sales contract, and the lower court failed to specify the nature of the contract. The high court rejected the appeal, reasoning that by applying Article 2272, paragraph 4, the lower court necessarily determined that the subscription contract constituted a contract of sale, making the short prescription applicable to the claim for the supply of goods (water) to a non-merchant consumer.

LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique :
Attendu qu'il est fait grief au jugement attaqué (tribunal d'instance de Belley, 16 novembre 1999) d'avoir déclaré prescrite l'action en paiement formée en 1998 par la société Sogedo contre Mme X..., au titre de factures d'eau émises en 1994, en vertu d'un contrat d'abonnement au service de distribution d'eau, alors, selon le moyen, que la courte prescription de l'article 2272, alinéa 4, du Code civil n'est pas applicable aux créances issues d'un contrat d'entreprise, même s'il s'accompagne de fournitures ; qu'en s'abstenant de préciser si le contrat d'abonnement constituait un contrat de vente, pour s'en tenir à la seule circonstance que l'eau devait être considérée comme une marchandise, le tribunal d'instance a privé sa décision de base légale ;
Mais attendu qu'aux termes de l'article 2272, alinéa 4, du Code civil, l'action des marchands, pour les marchandises qu'ils vendent aux particuliers non marchands, se prescrit par deux ans ; que les dispositions de ce texte sont applicables à toute société, pour les marchandises, fussent-elles de l'eau, qu'elle vend aux particuliers non marchands ; qu'en retenant que les conditions d'application de l'article 2272, alinéa 4, du Code civil étaient remplies, le jugement a, par là même, nécessairement relevé que le contrat d'abonnement constituait un contrat de vente ; que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne la société Sogedo aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du trois décembre deux mille deux.
