LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :

Vu les articles L. 131-2 et L. 131-3 du Code de l'organisation judiciaire ;

Ordonne le renvoi devant l'Assemblée plénière du pourvoi n° Y 01-14.722 formé par M. X... contre l'arrêt n° 99-10.980 de la cour d'appel de Paris du 28 mai 2001 ;

Réserve les dépens ;

Ainsi fait et jugé par la Cour de Cassation, Deuxième chambre civile, et prononcé par le président en son audience publique du six février deux mille trois.
