International Arbitration Classification Upheld
Synthèse Legislator
Généré par l'IAA party appealed a decision that deemed an arbitration between it and another entity to be international, thus making an appeal inadmissible. The court upheld the finding that the arbitration was international because the dispute involved entities from different countries (one Italian and one Dutch) concerning the financing of films partially shot in a third country and related to international economic operations affecting international trade, correctly leading the lower court to conclude that the appeal was barred.

Attendu que la société Babel productions fait grief à l'arrêt attaqué (Paris, 29 mars 2001) d'avoir qualifié l'arbitrage l'opposant à la société Carthago films d'arbitrage international contre lequel la voie de l'appel est irrecevable ;
Mais attendu que l'arrêt relève que le litige dans lequel intervenaient une société italienne et une société de droit néerlandais pour le financement de films tournés pour partie en Tunisie et que des demandes étaient relatives à l'inopposabilité de conventions intervenues entre la société Carthago films et la société étrangère Accent, à la prise en compte du financement total apporté par les sociétés Accent y compris en Italie ainsi qu'à l'ensemble des recettes y compris celles initialement attribuées au groupe italien, tous éléments devant permettre de déterminer les droits revendiqués par la société Babel productions ;
qu'ayant ainsi retenu que le différend s'inscrivait dans le cadre d'une opération économique internationale mettant en cause les intérêts du commerce international, la cour d'appel en a exactement déduit que cet arbitrage était international ; que le moyen, qui s'attaque à un motif surabondant en sa seconde branche, manque en fait en sa première ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne la société Babel productions aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du trois juin deux mille trois.
