Expropriation Appeal Dismissed Due to Correctable Procedural Error
Synthèse Legislator
Généré par l'IAThe court rejected an appeal concerning an expropriation order where the appellant claimed the procedure was flawed due to the omission of the current owners' identities in the parcel register, but the Court of Cassation found this omission to be a material error correctable under rules applicable to judgment rectification, not grounds for cassation. Furthermore, the court noted that the appellant had received notification of the parcel survey inquiry period, which ran from May 5 to May 26, 1999, making the appeal partially inadmissible and ultimately unfounded.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, ci-après annexé :
Attendu, d'une part, que l'absence d'indication de l'identité des héritiers de M. Georges X..., propriétaires actuels de la parcelle expropriée et désignés comme tels dans l'état parcellaire annexé à l'arrêté de cessibilité visé par l'ordonnance d'expropriation, constitue une omission matérielle qui, pouvant être réparée selon les mêmes règles que celles applicables à la rectification des jugements, ne donne pas ouverture à cassation ;
Attendu, d'autre part, qu'il résulte du dossier que Mme Edith X... a reçu, le 5 mai 1999, la notification du dépôt en mairie du dossier d'enquête parcellaire, cette enquête s'étant déroulée du 5 au 26 mai 1999 ;
D'où il suit que le moyen, pour partie irrecevable, n'est pas fondé pour le surplus ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne Mme X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du six mai deux mille trois.
