Moroccan National Detention Extension Appeal Inadmissibility Upheld
Synthèse Legislator
Généré par l'IAAn individual of Moroccan nationality, subject to an order of removal from the territory and subsequent detention, appealed the extension of this detention granted by a delegated judge, but the First President of the Court of Appeal declared the appeal inadmissible. The Court of Cassation upheld this decision, reasoning that the First President had legally justified the inadmissibility because the appellant failed to provide any grounds or motivation for the appeal, thus violating the mandatory requirement for motivation stipulated in the implementing decree related to the legal provision authorizing the detention extension.

LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique :
Attendu, selon l'ordonnance attaquée rendue par un premier président (Orléans, 9 mars 2001), que M. X..., de nationalité marocaine, a été l'objet d'un arrêté de reconduite à la frontière, puis, après son interpellation, d'une décision de maintien en rétention dans des locaux ne dépendant pas de l'administration pénitentiaire ; que le préfet d'Indre-et-Loire ayant demandé la prolongation de cette mesure en application de l'article 35 bis de l'ordonnance du 2 novembre 1945, le juge délégué a accordé cette prolongation ; que l'étranger ayant fait appel, le premier président a déclaré son recours irrecevable ;
Attendu que M. X... fait grief à l'ordonnance d'avoir ainsi statué alors, selon le moyen, qu'il était effectivement domicilié dans l'hôtel tenu par sa soeur ;
Mais attendu que l'ordonnance relève que l'appel interjeté par M. X... n'était pas motivé ;
Que par cette constatation, dont il résulte que l'intéressé n'a pas respecté l'obligation de motivation édictée par l'article 9, alinéa 1er, du décret du 12 novembre 1991 pris pour l'application de l'article 35 bis de l'ordonnance du 2 novembre 1945, le premier président a légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Ainsi fait et jugé par la Cour de Cassation, Deuxième chambre civile, et prononcé par le président en son audience publique du vingt-trois janvier deux mille trois.
