Real Estate Seizure Capacity Dispute and Appeal Admissibility
Synthèse Legislator
Généré par l'IAIn a dispute arising from real estate seizure proceedings initiated by two companies against a couple, where one of the initiating creditors, having been dissolved, had its request for extension of the seizure upheld by the initial court, the couple appealed, contesting the capacity of the now-dissolved creditor and alleging the inadmissibility of the appeal filed by the successor entity. The high court upheld the appellate court's decision to declare the appeal inadmissible, reasoning that because the initial court's judgment did not rule on the fundamental objection regarding the creditor's capacity (which was only raised on appeal), the judgment was not subject to an appeal under the relevant procedural article, and thus only an appeal to the high court was the proper recourse.

Généré par l'IAThis is the main order dismissing the appeal (pourvoi).
This article was cited by the lower court, and confirmed by the Cour de Cassation, as the reason why the appeal (appel) was inappropriate, leading to the dismissal of the appeal (which makes the subsequent rejection of the pourvoi logically follow).
This provision governs the order concerning court costs imposed on the losing party.
This article was applied to rule on the request for costs based on Article 700 filed by the winning parties.

LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, tel que reproduit en annexe :
Attendu, selon l'arrêt attaqué (Rouen, 30 octobre 2001) que la société Comptoir des fruits et primeurs et la société Rallye fruits ayant engagé des poursuites de saisie immobilière à l'encontre de M. et Mme X..., les poursuivants, la société Fruit expansion import se trouvant aux droits de la société Rallye fruits, ont demandé à un tribunal de grande instance de proroger les effets du commandement de saisie ;
que le Tribunal ayant accueilli la demande, M. et Mme X... ont interjeté un appel-nullité, en contestant la capacité pour agir de la société Fruit expansion import, laquelle avait été dissoute antérieurement à la demande de prorogation et dont la personnalité morale avait disparu ;
que la société Pomona est intervenue à l'instance d'appel et a demandé à la cour d'appel de constater qu'elle venait aux droits de la société Fruit expansion import ;
Attendu que M. et Mme X... font grief à l'arrêt d'avoir déclaré l'appel irrecevable ;
Mais attendu qu'après avoir constaté que M. et Mme X... n'avaient pas comparu en première instance ni soulevé le défaut de capacité de la société Fruit expansion import, l'arrêt retient à bon droit que le jugement qui n'a pas statué sur un moyen de fond n'était pas susceptible d'appel en vertu de l'article 731, alinéa 2, du Code de procédure civile ;
Et attendu qu'ayant relevé à juste titre que seule la voie du pourvoi en cassation était ouverte, la cour d'appel en a exactement déduit que l'appel-nullité ne pouvait être exercé ; que par ces seuls motifs, la cour d'appel a légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne les époux X... aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, rejette la demande de la société Comptoir des fruits et primeurs et de la société Pomona ;
Ainsi fait et jugé par la Cour de Cassation, Deuxième chambre civile, et prononcé par le président en son audience publique du dix juillet deux mille trois.
