Expropriation for Public Utility Affirmed Despite Mixed Development Including Social Housing
Synthèse Legislator
Généré par l'IAThe Court of Cassation rejected an appeal regarding an expropriation for public utility, affirming the lower court's finding that the objectives of the declaration of public utility were met when the expropriated land was used for a mixed development including social housing and various neighborhood facilities such as an annex town hall, community hall, post office, local shops, and an elderly residence managed by the municipal social action center. The reasoning centered on the fact that the concept of neighborhood equipment is not limited to purely public facilities but can include social housing that communes must promote, and that integrating these facilities into a larger project, even one involving substantial housing, is a permissible modality for fulfilling the public utility obligation without contravening the intended purpose.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, ci-après annexé :
Mais attendu qu'ayant constaté qu'un jardin public avait été créé , que les locaux réalisés par la société Promologis abritaient une mairie annexe, une salle polyvalente, un bureau de poste, divers commerces de proximité et un foyer résidence pour personnes âgées géré par le centre communal d'action sociale et sanitaire et relevé que la notion d'équipement de quartier ne recouvrait pas seulement la réalisation d'équipements publics mais pouvait comprendre celle de logements et en particulier de logements sociaux qu'il appartient aux communes de promouvoir, que les équipements publics devaient s'intégrer dans un tissu urbain correspondant à la vocation du quartier, que leur seule réalisation sur des terrains d'une superficie importante conduirait à un renchérissement de leur coût, que cette intégration dans un ensemble plus important ne constituait qu'une modalité de l'exécution de l'obligation imposée à la commune de respecter l'objectif visé par la déclaration d'utilité publique et que ces modalités pouvant en elles-mêmes justifier une expropriation pour cause d'utilité publique n'étaient pas contraires à la notion d'équipement de quartier, la cour d'appel qui a retenu que les objectifs de la déclaration d'utilité publique avaient été réalisés, a, sans dénaturation, légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne les époux X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du douze mars deux mille trois.
