Dispute Over Alleged Remaining Debt from 1986 Property Sale
Synthèse Legislator
Généré par l'IAThe Court of Cassation rejected an appeal stemming from a dispute over a remaining debt of 200,000 francs allegedly due under a private agreement from 1986 concerning the sale of property, where the property was ultimately sold in 1989 for 550,000 francs. The appellate court had properly dismissed the claim for the balance because its finding that the claimant received 550,000 francs, covering the principal and vendor loan interest documented in the authentic deed, necessarily rejected the existence of any outstanding balance, and the claimant was estopped from arguing for the first time on appeal that the 1986 agreement was intended to conceal part of the sales price in violation of tax law, as this argument was raised below by the opposing party without a response from the claimant.

Généré par l'IAThe court mentioned this article in the reasoning regarding the second branch of the appeal, stating that the appellant was inadmissible to raise a new argument based on it for the first time before the Court of Cassation, although this specific article was not the main ground for the final rejection order itself, but rather the basis for declaring an argument inadmissible.
This article is cited implicitly through the order condemning the appellant to pay the costs.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Attendu qu'aux termes d'un acte sous-seing privé en date du16 août 1986, M. X... s'est reconnu débiteur envers M. Y... d'une somme de 500 000 francs au titre de la vente d'une maison et d'un terrain ; que ces biens ont été acquis le 21 avril 1989 par M. X... pour le prix indiqué, M. Y... percevant en l'occasion 550 000 francs ; que l'arrêt attaqué (Nîmes, 1er février 2000), rendu après cassation (Première chambre civile, 27 janvier 1998, E 95-21.268) a débouté M. Y... de sa demande en paiement d'un solde de 200 000 francs au titre de l'acte de 1986 ;
Sur la recevabilité du pourvoi :
Attendu que la circonstance que M. Y..., intimé, n'ait ni comparu ni conclu en appel ne le rend pas irrecevable à se pourvoir en cassation ;
Et sur le moyen unique, pris en ses deux branches, tel qu'énoncé au mémoire en demande et reproduit en annexe :
Attendu, sur la première branche, que les constatations de la cour d'appel, selon lesquelles M. Y... a été totalement désintéressé par sa perception de la somme de 550 000 francs, correspondant au principal du prix de vente mentionné dans l'acte authentique et aux intérêts du prêt vendeur, écartent nécessairement celles du tribunal relatives à un solde subsistant ; que, sur la seconde branche, M. Y... qui, s'étant abstenu de constituer avoué, n'a pas défendu au moyen développé par M. X... selon lequel l'acte de 1986 avait eu pour objet de concrétiser la cession projetée, sauf alors à dissimuler une partie du prix de vente en violation de l'article 1840 du Code général des impôts, est irrecevable à le faire pour la première fois devant la Cour de Cassation ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. Y... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du vingt-cinq mars deux mille trois.
