Sanction for Reckless Civil Complaint Upheld
Synthèse Legislator
Généré par l'IAThe appellant was sanctioned by the lower court for initiating a civil complaint against the respondent with recklessness and rashness, resulting in an award of damages. The Supreme Court rejected the appeal, finding that the appellant's arguments, which alleged violations of civil code articles concerning evidence and liability, essentially sought a re-evaluation of the facts already soberly assessed by the appellate court, which had, with proper motivation and without improperly shifting the burden of proof, established the appellant's fault and resulting liability.

LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, tel que reproduit en annexe :
Attendu que M. X... fait grief à l'arrêt attaqué (Lyon, 16 mai 2001) de l'avoir condamné à verser des dommages-intérêts à M. Y... pour avoir déposé avec légèreté et témérité une plainte avec constitution de partie civile ;
Mais attendu que sous le couvert de griefs non fondés de violation des articles 1315 et 1382 du Code civil, le moyen ne tend qu'à remettre en discussion devant la Cour de Cassation l'appréciation souveraine des éléments de preuve par la cour d'appel qui, par une décision motivée et sans inverser la charge de la preuve, a pu retenir que M. X... avait commis une faute, engageant sa responsabilité ;
D'où il suit que le moyen ne peut qu'être écarté ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Deuxième chambre civile, et prononcé par le président en son audience publique du vingt-trois janvier deux mille trois.
