Surety Agreement Interpretation Dispute
Synthèse Legislator
Généré par l'IAThe Supreme Court rejected an appeal concerning the interpretation of an ambiguous clause in a surety agreement provided by an insurer to a compensation fund, where the appellant argued that the clause established the same termination date for both the coverage obligation and the settlement obligation of the guarantor. The Court held that the sole ground of appeal, which alleged misrepresentation, violation of law, and lack of legal basis, fundamentally sought to re-litigate the necessary and sovereign interpretation of the ambiguous terms of the surety contract, which assigned a common extinction term to both obligations, and therefore could not be upheld.

Attendu que sous couvert de griefs non fondés de dénaturation, violation de la loi et manque de base légale, le moyen, en ses trois branches, ne tend qu'à remettre en discussion l'interprétation nécessaire, partant souveraine, des termes ambigus de la clause du cautionnement consenti à la Caisse de compensation des congés payés des ouvriers du port du Havre par la Compagnie générale de garantie, en ce qu'ils assignaient un même terme extinctif à l'obligation de couverture et à l'obligation de règlement incombant à la caution ; qu'il ne saurait être accueilli ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne la Compagnie générale de garantie aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, condamne la Compagnie générale de garantie à payer à la Caisse de compensation des congés payés des ouvriers du port du Havre la somme de 1 500 euros ; rejette la demande de la Compagnie générale de garantie ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du dix décembre deux mille deux.
