Appeal Struck Out Due to Appellant's Death and Failure to Substitute Heirs
Synthèse Legislator
Généré par l'IAAn appeal was lodged by an individual against a lower court decision concerning a dispute involving another individual and an insurance company, with a health insurance fund also involved; however, the appealing party died in October 2001, leading to the interruption of the proceedings, and subsequently, the appellant's counsel indicated in October 2002 that they were unable to resume the action on behalf of the deceased's heirs within the stipulated four-month period following the official acknowledgment of the interruption. Consequently, the Court of Cassation ordered the striking out of the appeal, holding the deceased's estate responsible for the costs, pursuant to the relevant provision of the Code of Civil Procedure concerning the continuation or conclusion of proceedings following the death of a party.
