Agricultural Land Preemption Right Renunciation Dispute
Synthèse Legislator
Généré par l'IAThe dispute concerned the alleged renunciation of a right of preemption regarding agricultural land, where one party claimed they only intended not to renew a lease based on prior writings, while the other asserted the right was waived by vacating the parcels on a specific date. The court upheld the lower court's decision, reasoning that the appellate court, acting within its sovereign power to assess facts, reasonably concluded that only pre-sale writings indicated an intent not to renew, that the condition allegedly attached to the renunciation of the preemption right was not proven, and that the vacating of the land constituted a renunciation of the right to renewal, thereby legally justifying the rejection of the appeal.

défendeur à la cassation ;
Le demandeur invoque, à l'appui de son pourvoi, le moyen unique de cassation annexé au présent arrêt ;
Vu la communication faite au Procureur général ;
LA COUR, en l'audience publique du 19 mars 2002, où étaient présents : M. Weber, président, M. Peyrat, conseiller rapporteur, Mlle Fossereau, conseiller doyen, M. Cédras, avocat général, Mme Berdeaux, greffier de chambre ;
Sur le rapport de M. Peyrat, conseiller, les observations de la SCP Peignot et Garreau, avocat de M. X..., de Me Blondel, avocat de M. Y..., les conclusions de M. Cédras, avocat général, et après en avoir délibéré conformément à la loi ;
Sur le moyen unique, ci-après annexé :
Attendu qu'ayant souverainement retenu que les seuls écrits antérieurs à l'acte de vente du 27 juin 1991 exprimaient la volonté de M. Y... de ne pas renouveler le bail, qu'il ne rapportait pas la preuve de la condition à laquelle il affirmait avoir subordonné sa renonciation à l'exercice de son droit de préemption et qu'il avait renoncé à son droit de renouvellement en quittant les parcelles cadastrées section AE numéros 19 et 20 le 11 novembre 1993, la cour d'appel, qui n'était pas tenue de procéder à des recherches que ses constatations rendaient inopérantes ni de suivre les parties dans le détail de leur argumentation, a, répondant aux conclusions, légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du vingt-neuf avril deux mille deux.
