Guarantor Liability and Interest Rate Validity in Loan Guarantee Case
Synthèse Legislator
Généré par l'IAThe defendant was ordered by the lower court to pay a sum plus conventional interest to the plaintiffs as a guarantor for a loan taken by a third party. The defendant appealed, arguing that the plaintiffs' failure to declare their claim in the third party's judicial liquidation deprived the defendant of a subrogatory recourse, and that the conventional interest rate obligation was not proven because the loan agreement lacked the required handwritten mention. The Court of Cassation rejected the appeal, holding that the argument regarding the lack of subrogatory recourse was not raised at the appellate level, and that the claim concerning the interest rate was unfounded as the court correctly determined that the plaintiffs were only reserved the faculty, not obliged, to register a mortgage on the borrowers' property.

Attendu que l'arrêt attaqué (Aix-en-Provence, 1er juin 1999) condamne Mme X... à payer aux époux Y... une certaine somme avec intérêts au taux conventionnel, en exécution du cautionnement solidaire qu'elle avait consenti pour garantir le remboursement de l'emprunt contracté par les époux Z... ;
Attendu, d'une part, que Mme X... n'avait pas soutenu devant les juges d'appel qu'elle devait être déchargée de son obligation, en raison de ce que le défaut de déclaration de créance des époux Y... à la liquidation judiciaire de Mme Z... l'aurait privée d'un recours subrogatoire à l'encontre de celle-ci, ni que la preuve de son obligation au paiement d'intérêts au taux conventionnel n'aurait pas été rapportée, faute par l'acte du 9 février 1993 de comporter la mention manuscrite de cet engagement ; que, d'autre part, en constatant que les époux Y... ne s'étaient pas obligés à inscrire une hypothèque sur l'immeuble des emprunteurs, mais s'en étaient seulement réservé la faculté, la cour d'appel a légalement justifié sa décision du chef critiqué ; que, nouveau et mélangé de fait, partant irrecevable, en ses première et troisième branches, le moyen est mal fondé en son deuxième grief ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne Mme X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du vingt-six novembre deux mille deux.
