Windows Opening Onto Adjacent Terrace Dispute
Synthèse Legislator
Généré par l'IAThe case concerned a dispute over windows opening onto an adjacent terrace, where the originating parcel had initially been unbuilt land, and the windows previously opened onto a blind roof, causing no inconvenience. The appellate court correctly justified its decision by noting that since the windows currently opened onto the adjacent terrace, the initial conditions of the property's composition and the lack of prior nuisance rendered arguments regarding the original situation inoperative, thus affirming the lower court's ruling without improperly shifting the burden of proof.

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique :
Attendu qu'ayant constaté que s'il ressortait de l'extrait cadastral que les deux propriétés étaient englobées à l'origine dans la même parcelle, celle-ci était constituée de terres non bâties, et relevé que les deux fenêtres donnaient avant 1965 sur un toit aveugle, de sorte qu'elles ne pouvaient causer aucune gêne susceptible de provoquer la contradiction des consorts X..., et qu'elles ouvraient depuis sur la terrasse des consorts X..., la cour d'appel, qui n'était pas tenue de répondre à des conclusions que ses constatations rendaient inopérantes a, sans inverser la charge de la preuve, légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne Mme Y... aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, condamne Mme Y... à payer à Mme Z... la somme de 1 800 euros ;
Vu l'article 700 du nouveau Code de procédure civile, rejette la demande de Mme Y... ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du vingt-quatre septembre deux mille deux.
