Financial Arrangement Tax Reduction Property Investment Dispute
Synthèse Legislator
Généré par l'IAThe Court of Cassation rejected an appeal concerning a financial arrangement involving a property investment aimed at a tax reduction, where the appellant suffered losses related to renovation work payments. The appellate court had found that the financial services company fulfilled its contractual obligations by correctly demonstrating that it merely proposed the tax-saving structure without assuming responsibility for the subsequent real estate execution, particularly the transfer of funds to the contractor responsible for the renovation, thus legally justifying the decision to absolve the company.

LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, pris en ses trois branches, ci-après annexé :
Attendu que la cour d'appel (Toulouse, 17 janvier 2000), a retenu que la société Structure Gestion Finance avait respecté ses obligations contractuelles, en relevant qu'elle avait proposé à M. X... un montage financier, comportant un investissement immobilier, destiné à obtenir une réduction d'impôts, mais sans obligation d'intervention dans la réalisation de l'opération immobilière envisagée, notamment pour le versement des fonds à l'entrepreneur chargé de travaux de rénovation, source du préjudice subi par M. X... ; que, sans avoir à répondre à une simple argumentation, la cour d'appel a ainsi légalement justifié sa décision ;
Que le moyen, partiellement nouveau et donc irrecevable, ne peut être accueilli ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, rejette la demande de M. X... ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du dix-huit septembre deux mille deux.
