AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Attendu que, par acte déposé au greffe de la Cour de Cassation le 18 novembre 2002, la SCP Gatineau, avocat à la Cour de Cassation, a déclaré, au nom des consorts X..., se désister du pourvoi formé par eux contre un arrêt rendu le 27 septembre 2000 par la cour d'appel de Paris, au profit de la SCI des 11 à 19 rue Ribera à Paris ;
Que ce désistement, intervenu après le dépôt du rapport, doit, aux termes de l'article 1026 du nouveau Code de procédure civile, être constaté par arrêt ;
PAR CES MOTIFS :
DONNE acte aux consorts X... du désistement de leur pourvoi ;
Condamne les consorts X... aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, condamne les consorts X... à payer à la SCI des 11 à 19, rue Ribera à Paris la somme de 1 900 euros ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du vingt-neuf janvier deux mille trois.
