Extinguishment of Non-Transferable Visitation Rights Upon Appellant's Death
Synthèse Legislator
Généré par l'IAThe Supreme Court considered an appeal filed by an individual concerning their right to visit a child placed with child protective services, an action which, by its nature, was non-transferable. The appellant died while the cassation proceedings were pending before the court. Therefore, the court concluded that the instance must be extinguished because the action itself could not be transmitted to any successor, as mandated by the rules governing the cessation of proceedings, leading to the court relinquishing its jurisdiction over the matter.
