Employer v. Employee: Refusal to Stay Provisional Enforcement of Labor Judgment
Synthèse Legislator
Généré par l'IAAn employer sought to overturn a decision by the President of the Court of Appeal that refused to stay the provisional enforcement of a judgment rendered by the labor tribunal against the employer in favor of an employee. The employer argued the lower court failed to address its arguments and violated procedural rules regarding the enforcement order. The Court of Cassation rejected the appeal, finding the argument regarding the lower court's failure to respond to the opposing party's arguments inadmissible since the appellant was the original claimant in the preliminary proceedings, and further holding that the President of the Court of Appeal correctly determined they lacked the power to stay the provisional enforcement attached by law to the initial judgment, regardless of allegations of legal errors or violations of the right to defense in that decision.

défendeur à la cassation ;
LA COUR, en l'audience publique du 19 décembre 2000, où étaient présents : M. Waquet, conseiller doyen, faisant fonctions de président, M. Ransac, conseiller rapporteur, M. Lanquetin, conseiller, M. Frouin, conseiller référendaire, M. Lyon-Caen, avocat général, Mme Ferré, greffier de chambre ;
Sur le rapport de M. Ransac, conseiller, les conclusions de M. Lyon-Caen, avocat général, et après en avoir délibéré conformément à la loi ;
Sur les moyens, tels qu'ils figurent au mémoire en demande annexé au présent arrêt :
Attendu que la société Inter Formation SE Woippy 2000 fait grief à l'ordonnance de référé attaquée, rendue par le premier président de la cour d'appel (Metz, 22 octobre 1998), d'avoir rejeté sa demande d'arrêt de l'exécution provisoire du jugement rendu par le conseil de prud'hommes dans l'instance qui l'oppose à son salarié, M. X..., pour les motifs exposés dans le mémoire susvisé, qui sont pris d'un défaut de réponse à conclusions et d'une violation de l'article 524 du nouveau Code de procédure civile en l'état des irrégularités affectant la décision assortie de l'exécution provisoire ;
Mais attendu, d'abord, que la Société Inter formation SE Woippy 2000, qui avait la qualité de demandeur en référé, est sans intérêt à invoquer un prétendu défaut de réponse aux conclusins du défendeur qui soulevait l'irrecevabilité de la demande ; que le moyen est irrecevable ;
Attendu, ensuite, que le premier président a retenu qu'il n'avait pas le pouvoir d'arrêter l'exécution provisoire attachée de plein droit au jugement, peu important l'allégation d'erreurs de droit ou d'une violation des droits de la défense affectant celui-ci ; qu'il a ainsi légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne la société Inter Formation S.E. Woippy 2000 aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Chambre sociale, et prononcé par le président en son audience publique du treize février deux mille un.
