Boundary Dispute and Implied Co-ownership of Wall
Synthèse Legislator
Généré par l'IAThe appellants contested a lower court decision regarding a boundary dispute, asserting that the appellate court erred by not ruling on the specific location of a wall and by failing to find that their consent to the construction of an adjacent garage implied an agreement to transfer co-ownership of the disputed wall. The highest court dismissed the appeal, reasoning that the appellate court had not been asked to rule on the wall's precise placement, nor had it concluded that the consent to the garage construction amounted to a cession of the wall's joint ownership, thereby finding the stated ground for appeal unfounded.

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le pourvoi formé par :
1 / Mme A..., née Cécile Z..., demeurant ... (Morbihan),
2 / M. A... Robert, demeurant Résidence du Zéphir à Hyères (Var),
3 / M. Ninivin X..., demeurant ...
2 / de Mme Y..., son épouse, demeurant Le Vieux Passage du Mané Jouan à Plouhinec (Morbihan), défendeurs à la cassation ;
Les demandeurs invoquent, à l'appui de leur pourvoi, le moyen unique de cassation annexé au présent arrêt :
LA COUR, composée selon l'article L. 131-6, alinéa 2, du Code de l'organisation judiciaire, en l'audience publique du 21 mars 1995, où étaient présents : M. Beauvois, président, Mme Giannotti, conseiller rapporteur, M. Douvreleur, conseiller doyen, M. Sodini, avocat général, Mme Pacanowski, greffier de chambre ;
Sur le rapport de Mme le conseiller Giannotti, les observations de la SCP Delaporte et Briard, avocat des consorts A..., de la SCP Le Bret et Laugier, avocat des époux Y..., les conclusions de M. Sodini, avocat général, et après en avoir délibéré conformément à la loi ;
Sur le moyen unique, ci-après annexé :
Attendu que la cour d'appel n'était pas saisie de la question de l'implantation du mur et n'a pas retenu que l'accord des époux A... à la construction du garage des époux Y... impliquait leur accord pour céder la mitoyenneté du mur litigieux ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne les consorts A... aux dépens et aux frais d'exécution du présent arrêt ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par M. le président en son audience publique du dix mai mil neuf cent quatre-vingt-quinze.
