Eviction Indemnity Assessment Upheld
Synthèse Legislator
Généré par l'IAThe appellants challenged a decision regarding the indemnity for eviction, arguing that the lower court erred in its assessment of the facts. The Court of Cassation upheld the appellate court's decision, reasoning that the court of appeal was not obligated to respond to mere arguments concerning the amount of the indemnity, and having sovereignly determined that certain companies benefited only from a gratuitous domiciliation, the alleged breach, even if established against one entity, was not sufficiently serious to warrant the forfeiture of the right to eviction compensation.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le pourvoi formé par :
1 / M. Claude X..., demeurant ... (7e),
2 / M. Pierre Y..., demeurant ... (16e), en cassation d'un arrêt rendu le 10 mars 1992 par la cour d'appel de Paris (16e chambre A), au profit de la Société d'organisation de gestion et de marketing (SORGEM), sise ... (17e), défenderesse à la cassation ;
Les demandeurs invoquent, à l'appui de leur pourvoi, les deux moyens de cassation annexés au présent arrêt ;
LA COUR, en l'audience publique du 30 mars 1994, où étaient présents : M. Beauvois, président, M. Chollet, conseiller référendaire rapporteur, MM. Douvreleur, Peyre, Mme Giannotti, MM. Aydalot, Boscheron, Toitot, Mme Di Marino, MM. Villien, Bourrelly, conseillers, M. Pronier, Mme Masson-Daum, conseillers référendaires, M. Mourier, avocat général, Mme Pacanowski, greffier de chambre ;
Sur le rapport de M. le conseiller référendaire Chollet, les observations de Me Boullez, avocat de MM. X... et Z..., de Me Choucroy, avocat de la SORGEM, les conclusions de M. Mourier, avocat général, et après en avoir délibéré conformément à la loi ;
Sur les deux moyens, réunis, ci-après annexés :
Attendu que la cour d'appel, qui n'avait pas à répondre à de simples arguments quant au montant de l'indemnité d'éviction et qui, ayant souverainement retenu que les sociétés Sotrade et Sorgem participation avaient bénéficié d'une simple domiciliation à titre gratuit, et qu'à supposer le manquement établi pour la société Sorgem organisation, celui-ci n'aurait pas été suffisamment grave pour entraîner la déchéance du droit à indemnité d'éviction, a légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne, ensemble, MM. X... et Y..., envers la SORGEM, aux dépens et aux frais d'exécution du présent arrêt ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par M. le président en son audience publique du dix-huit mai mil neuf cent quatre-vingt-quatorze.
