Insurance Policy Interpretation Regarding Roadway and Sidewalk Coverage
Synthèse Legislator
Généré par l'IAThe case involved an appeal concerning the interpretation of an insurance policy covering road works intended for the private service of a building structure, where the policyholder argued that damages to roadways and sidewalks should be covered. The Court of Cassation rejected the appeal, reasoning that the appellate court's decision to exclude coverage for damages to these roadways and sidewalks was based on a necessary interpretation of the ambiguous policy terms—which determined that the structures were not for the private use of the lot owners but served collective access—and this interpretation, which relied on the criterion of the works' destination, fell within the appellate court's sovereign power and did not constitute a distortion of the contract.

défenderesse à la cassation ;
La demanderesse invoque, à l'appui de son pourvoi, le moyen unique de cassation annexé au présent arrêt ;
LA COUR, composée selon l'article L. 131-6, alinéa 2, du Code de l'organisation judiciaire, en l'audience publique du 29 avril 1993, où étaient présents : M. de Bouillane de Lacoste, président, M. Jean-Pierre Ancel, conseiller rapporteur, M. Viennois, conseiller, M. Lesec, avocat général, Mlle Ydrac, greffier de chambre ;
Sur le rapport de M. le conseiller Jean-Pierre Ancel, les observations de Me Pradon, avocat de la société Entreprise Jean Lefebvre, de la SCP Masse-Dessen eorges et Thouvenin, avocat de la société CompagnieAN, les conclusions de M. Lesec, avocat général, et après en avoir délibéré conformément à la loi ;
Sur le moyen unique, tel qu'il est énoncé au mémoire en demande et ci-après reproduit :
Attendu qu'en l'état des stipulations de la police garantissant les ouvrages de voirie dont la destination est la desserte privative d'un ouvrage de bâtiment, c'est par une interprétation rendue nécessaire par l'ambiguïté de ses termes et, partant, exclusive de la dénaturation alléguée, que la cour d'appel a estimé qu'étaient exclus de la garantie les désordres affectant des chaussées et trottoirs qui n'étaient pas affectés à l'usage privatif des propriétaires des pavillons du lotissemnt, dont ils assuraient la desserte collective, en faisant du critère de la destination des ouvrages une appréciation qui relève de son pouvoir souverain ; que le moyen n'est donc fondé en aucun de ses griefs ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
! Condamne la société Entreprise Jean Lefebvre, envers la société CompagnieAN, aux dépens et aux frais d'exécution du présent arrêt ;
