Construction Defect Appeal: Tacit Acceptance and Statute of Limitations
Synthèse Legislator
Généré par l'IAThe appeal concerned a dispute over construction defects where the appellate court determined that the reported damages related to work completed in 1974, based on expert findings, and could not stem from subsequent work in 1977. The court reasoned that since the appellant took possession of the premises in 1974 and delayed initiating legal action regarding the 1974 work until 1986, this delay constituted tacit acceptance of the 1974 construction, and further, the specific statutory article cited by the appellant was deemed inapplicable, thus legally justifying the rejection of the appeal.
