Property Company v. Rent Disputes Appeal: Scope of Appellate Review and New Arguments on Prescription
Synthèse Legislator
Généré par l'IAA property company appealed a judgment concerning rent disputes, arguing the appellate court erred by not investigating a matter it was not asked to review and by basing its decision on an argument regarding the inapplicability of the five-year prescription period, which had not been raised below. The Court of Cassation rejected the appeal, reasoning that the appellate court was not obligated to conduct an inquiry beyond what was requested, and that the appellant's argument concerning the prescription of the rent claims was inadmissible because it was a new argument, mixing fact and law, that had not been presented to the Court of Appeal.

(Haute-Garonne),
défendeur à la cassation ;
La demanderesse invoque, à l'appui de son pourvoi, le moyen unique de cassation annexé au présent arrêt ;
LA COUR, en l'audience publique du 26 janvier 1993, où étaient présents : M. Beauvois, président, M. Peyre, conseiller rapporteur, MM. Vaissette, Cathala, Douvreleur, Mme Giannotti, MM. Aydalot, Boscheron, Toitot, Mme Di Marino, M. Fromont, conseillers, MM. Chollet, Pronier, conseillers référendaires, M. Sodini, avocat général, Mlle Jacomy, greffier de chambre ;
Sur le rapport de M. le conseiller Peyre, les observations de la SCP Peignot etarreau, avocat de la Société foncière familiale du Tor, les conclusions de M. Sodini, avocat général, et après en avoir délibéré conformément à la loi ;
Sur le moyen unique, ci-après annexé :
Attendu, d'une part, que la cour d'appel n'avait pas à procéder à une recherche qui ne lui était pas demandée ;
Attendu, d'autre part, que la Société foncière familiale du Tor n'ayant pas soutenu devant la cour d'appel que les loyers faisant l'objet d'un litige, la prescription quinquennale était sans application, le moyen est nouveau, mélangé de fait et de droit ;
D'où il suit que le moyen, pour partie irrecevable, n'est pas fondé pour le surplus ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne la Société foncière familiale du Tor, envers M. X..., aux dépens et aux frais d'exécution du présent arrêt ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par M. le président en son audience publique du trois mars mil neuf cent quatre-vingt-treize.
