Husband's Appeal on Marital Separation Denied
Synthèse Legislator
Généré par l'IAThe husband appealed a judgment from the Court of Appeal that granted a separation of body against him due to marital misconduct, but the high court rejected the appeal. The appellate court had found, based on witness statements and a police report, that the husband constantly threatened his wife and disrupted their professional and family life, constituting a serious breach of marital duties that made continuing cohabitation intolerable. The high court reasoned that the appellate court, having made these findings based on the submitted evidence without misinterpreting the documents, acted within its sovereign power to assess the facts and the weight of that evidence.

défenderesse à la cassation ;
Le demandeur invoque, à l'appui de son pourvoi, le moyen unique de cassation annexé au présent arrêt ;
LA COUR, composée selon l'article L. 131-6, alinéa 2, du Code de l'organisation judiciaire, en l'audience du 21 juillet 1992, où étaient présents : M. Dutheillet-Lamonthézie, président, M. Mucchielli, conseiller référendaire rapporteur, M. Chabrand, conseiller, M. Tatu, avocat général, Mme Rouquet, greffier de chambre ;
Sur le rapport de M. le conseiller référendaire Mucchielli, les observations de Me Blondel, avocat de M. X..., de la SCP Urtin-Petit et Rousseau-Van Troeyen, avocat de Mme X..., les conclusions de M. Tatu, avocat général, et après en avoir délibéré conformément à la loi ;
Sur le moyen unique, tel que reproduit en annexe :
Attendu que pour prononcer la séparation de corps des époux X... aux torts du mari, l'arrêt attaqué retient qu'il résulte de deux attestations et d'un procès-verbal de gendarmerie que M. X... menaçait constamment son épouse et troublait sa vie professionnelle et familiale, et que ces faits constituent une violation grave des devoirs et obligations du mariage rendant intolérable le maintien de la vie commune ;
Que par ces constatations et énonciations, la cour d'appel n'a fait, hors de toute dénaturation, qu'apprécier souverainement la portée et la valeur des documents qui lui étaient soumis ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
! Condamne M. X..., envers Mme X..., aux dépens et aux frais d'exécution du présent arrêt ;
Ainsi fait et jugé par la Cour de Cassation, Deuxième chambre civile, et prononcé par M. le président en son audience publique du vingt huit octobre mil neuf cent quatre vingt douze.
