Electoral List Contestation: Standing of Legal Entities in Labor Court Elections
Synthèse Legislator
Généré par l'IAThe Court of Cassation declared an appeal inadmissible because the right to contest an electoral list established for labor court elections belongs exclusively to the interested voters and the prefect, and only those parties who were part of the lower court proceedings can file a further appeal; consequently, a legal entity, even if it participated in the initial proceedings concerning the transfer of its employees between sections of the labor electoral list, is barred from appealing the decision regarding the list modification.

LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur la recevabilité du pourvoi :
Vu les articles L. 513-3, R. 513-21 et R. 513-25 du Code du travail et L. 25 et L. 27 du Code électoral ;
Attendu que le droit de contester la liste électorale établie en vue des élections prud'homales appartient exclusivement aux électeurs intéressés et au préfet ; que le pourvoi en cassation contre le jugement intervenu ne peut être formé que par les mêmes personnes, à condition qu'elles aient été parties devant le tribunal ;
Qu'il en résulte que le droit de se pourvoir contre une décision qui a ordonné une inscription sur les listes électorales prud'homales ne peut être exercé par une personne morale, même si elle a comparu à l'instance devant le tribunal ;
D'où il suit que le pourvoi formé par la société anonyme Siemens contre le jugement ayant radié vingt huit de ses salariés de la section "commerce" de la liste électorale prud'homale de la commune de Marseille et les ayant inscrit dans la section "industrie", n'est pas recevable ;
PAR CES MOTIFS :
Déclare le pourvoi IRRECEVABLE :
Ainsi fait, jugé et prononcé par la Cour de Cassation, Deuxième chambre civile, en son audience publique du vingt six novembre mil neuf cent quatre vingt douze ;
