Appeal Regarding Notification of Conclusions and Validity of Donation
Synthèse Legislator
Généré par l'IAThe case involves an appeal concerning a lower court's decision regarding the notification of legal conclusions and the validity of a donation. The appellants contended the lower court violated the adversarial principle by relying on conclusions that were refused upon notification. The court rejected this, reasoning that since the reality of the notification was established, the recipient's knowledge depended only on their own will. Additionally, the appellants challenged the lower court's finding that an irregularly executed donation, not formalized before a notary as required by civil code, resulted in absolute nullity, leading to the conclusion that the sole owner of the damaged house should exclusively receive a replacement property; the court also found this reasoning sound, ultimately rejecting the appeal.

M. Senselme, président, M. Douvreleur, conseiller rapporteur, MM. K..., O..., Z..., Y..., X..., L..., E..., J...
Attendu que, dès lors qu'était établie la réalité de la notification des conclusions litigieuses au conseil des époux N... qui les avait refusées, la cour d'appel n'a pas méconnu le principe du contradictoire en se référant à ces conclusions dont la connaissance, par la partie destinataire, ne dépendait que de la seule volonté de celle-ci ; D'où il suit que le moyen n'est pas fondé ;
REJETTE le pourvoi ;
