Property Boundary Dispute and Burden of Proof on Encroachment
Synthèse Legislator
Généré par l'IAThe appellant sought to overturn a decision that rejected his claim of encroachment onto his property by the appellee concerning the boundary defined by a pond, arguing the lower court misapplied the burden of proof. The Court of Cassation rejected the appeal, finding that the appellate court properly determined, based on its sovereign assessment of the facts, that neither the land registry nor the title proved encroachment because infilling by the appellee had altered the boundary's course, and furthermore, the appellant's own actions of removing boundary markers and altering the site rendered expert calculation of the parcel sizes impossible, thus justifying the rejection of the claim.

défendeur à la cassation ;
Le demandeur invoque à l'appui de son pourvoi, le moyen unique de cassation annexé au présent arrêt :
LA COUR, en l'audience publique du 11 décembre 1991, où étaient présents : M. Senselme, président, Mme Giannotti, conseiller rapporteur, MM. Paulot, Vaissette, Chevreau, Cathala, Douvreleur, Capoulade, Peyre, Deville, Aydalot, Boscheron, conseillers, M. Chollet, Mme Cobert, M. Pronier, conseillers référendaires, M. Angé, avocat général, Mlle Jacomy, greffier de chambre ;
Sur le rapport de Mme le conseiller Giannotti, les observations de la SCP Boré et Xavier, avocat de M. X..., de la SCP de Chaisemartin, avocat de M. Y..., les conclusions de M. Angé, avocat général, et après en avoir délibéré conformément à la loi ;
Sur le moyen unique, ci-après annexé :
Attendu que la cour d'appel a répondu aux conclusions et légalement justifié sa décision en retenant souverainement, sans inverser la charge de la preuve, d'une part, que ni le cadastre, ni le titre de propriété de M. X... n'établissaient un empiètement sur son terrain, car si la limite séparative des fonds avait été le bord de l'étang Casanove, les travaux de remblaiement effectués par M. Y... en avaient modifié le tracé, et, d'autre part, que les superficies des parcelles n'avaient pu être calculées en raison des agissements de M. X... qui, en faisant disparaître des bornes et en modifiant la configuration des lieux, avait rendu impossibles les investigations de l'expert ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
! Condamne M. X..., envers M. Y..., aux dépens et aux frais d'exécution du présent arrêt ;
