Property Boundary Dispute Appeal Costs Award
Synthèse Legislator
Généré par l'IAThe appellants contested a court of appeal decision that confirmed the boundary line between their property and that of the respondent should follow the trace AD established by an expert in a property dispute, leading to the appellants being ordered to pay the costs of the appeal. The Supreme Court rejected the appeal, reasoning that the appellate court, without distorting the expert's report or the parties' arguments, had sovereignly determined the boundary line based on the evidence presented and correctly assigned the resulting litigation costs to the unsuccessful appellants.

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le pourvoi formé par :
1°/ M. Joseph Z...,
(Pyrénées-orientales),
défendeur à la cassation ;
Les demandeurs invoquent à l'appui de leur pourvoi, les deux moyens de cassation annexés au présent arrêt :
LA COUR, composée selon l'article L. 131-6, alinéa 2, du Code de l'organisation judiciaire, en l'audience publique du 25 mars 1992, où étaient présents : M. Senselme, président, Mme Giannotti, conseiller rapporteur, M. Paulot, conseiller doyen, M. Mourier, avocat général, Mlle Jacomy, greffier de chambre ;
Sur le rapport de Mme le conseiller Giannotti, les observations de la SCP Nicolay et de Lanouvelle, avocat des époux Z..., de Me Choucroy, avocat de M. X..., les conclusions de M. Mourier, avocat général, et après en avoir délibéré conformément à la loi ;
Sur les deux moyens réunis, ci-après annexés :
Attendu que la cour d'appel, qui a, sans dénaturer les conclusions ni le rapport d'expertise, souverainement retenu qu'il convenait de fixer la ligne divisoire entre les fonds Z... et X... suivant le tracé AD du plan de l'expert, a pu condamner les époux Z..., qui succombaient en leur appel, à en supporter les dépens ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
! Condamne les époux Z..., envers le Trésorier payeur général et M. X..., aux dépens et aux frais d'exécution du présent arrêt ;
