Tenant Damages Claim Against Housing Provider for Priority Allocation Rejection Upheld
Synthèse Legislator
Généré par l'IAThe appeal concerned a tenant's claim for damages against a social housing provider after another applicant was awarded a dwelling, despite the tenant claiming priority due to the poor condition (dampness) of their current apartment. The Court of Cassation rejected the appeal, reasoning that the housing authority was justified in its decision because the statute governing priority allocation does not establish a strict preferential order among the stipulated conditions, and the tenant failed to prove a systematic refusal of her application; furthermore, the court properly found that the dampness in the existing dwelling resulted from a failure in the tenant's maintenance obligations, thereby justifying the rejection of the damages claim on that ground as well.

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le pourvoi formé par Mme Y... Chantal, demeurant ...
(Essonne),
défenderesse à la cassation ;
Paulot, Chevreau, Cathala, Valdès, Douvreleur, Capoulade, Beauvois, Deville, Darbon, Mme Giannotti,

Sur le rapport de M. le conseiller Chemin, les observations de Me Luc-Thaler, avocat de Mme Y..., de Me Roger, avocat de la société Immobilière 3 F, les conclusions de M. Vernette, avocat général, et après en avoir délibéré conformément à la loi ;

Attendu que l'arrêt qui, pour débouter Mme Y... de sa demande de dommages-intérêts à la suite de l'attribution par la société Foyer de la Famille et du Fonctionnaire, à un autre postulant, du logement HLM auquel elle prétendait avoir un droit prioritaire eu égard à l'exiguïté et à l'humidité de son appartement actuel, constate que cet autre candidat satisfaisait aux conditions requises par l'article R. 441-4 du Code de la construction et de l'habitation et relève que l'énumération des priorités faite dans cet article n'obéit pas à un ordre préférentiel, et que la preuve d'un refus systématique n'est pas rapportée, est légalement justifié de ce chef ;
Sur le second moyen, ci-après annexé :
Attendu que l'arrêt, qui retient que l'humidité provient d'un défaut d'entretien locatif, est, par ce seul motif, légalement justifié de ce chef ;
