Property Dispute Over Non-Apparent Right-of-Way
Synthèse Legislator
Généré par l'IAAn individual appealed a ruling concerning a property dispute where the lower court found that a path on the acquired property, which the buyers claimed was a pre-existing right-of-way, was not apparent and therefore not enforceable against them after their purchase. The high court dismissed the appeal, reasoning that the appellate court had the authority to determine, based on the evidence, that the buyers could reasonably believe the path was merely a tolerance and not an established servitude, thereby legally justifying the decision that the servitude was non-apparent and not opposable to the purchasers.
