Husband's Appeal Regarding Divorce Grant and Evidentiary Rulings Upheld
Synthèse Legislator
Généré par l'IAIn a dispute concerning a divorce, the husband appealed a decision that granted the divorce, arguing the appellate court erred by not suspending the proceedings pending the outcome of a complaint regarding the authenticity of affidavits it had already discounted, and by failing to investigate exculpatory circumstances regarding the husband's alleged marital misconduct without a specific request from him. The Court of Cassation rejected the appeal, reasoning that the appellate court was not obligated to await the results of a separate criminal proceeding concerning evidence it had already excluded, nor was it required to proactively examine potential justifications for the husband's conduct where the wife had not formally requested such consideration.

défenderesse à la cassation ;
Le demandeur invoque, à l'appui de son pourvoi, les deux moyens de cassation annexés au présent arrêt ;
LA COUR, composée selon l'article L. 131-6, alinéa 2, du Code de l'organisation judiciaire, en l'audience du 10 mai 1991, où étaient présents : M. Dutheillet-Lamonthézie, président, M. Bonnet, conseiller référendaire rapporteur, M. Chabrand, conseiller, M. Dubois de Prisque, avocat général, Mme Rouquet, greffier de chambre ;
Sur le rapport de M. le conseiller référendaire Bonnet, les observations de Me Choucroy, avocat de M. X..., les conclusions de M. Dubois de Prisque, avocat général, et après en avoir délibéré conformément à la loi ;
Donne défaut contre Mme X... ;
Sur les deux moyens réunis, tels que reproduits en annexe :
Attendu que la cour d'appel pour prononcer le divorce des époux X...-Y... n'avait pas à surseoir à statuer jusqu'au résultat d'une plainte pour faux concernant des attestations qu'elle a écartées des débats et n'avait pas, en l'absence de demande du mari, à rechercher d'office si les griefs reprochés à celui-ci n'étaient pas excusés par le comportement de la femme ;
D'où il suit que l'arrêt n'encourt pas les critiques du moyen ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
! Condamne M. X..., envers Mme Y..., aux dépens et aux frais d'exécution du présent arrêt ;
