Employee Appeal on Interest Accrual Date in Unfair Dismissal Case
Synthèse Legislator
Généré par l'IAAn employee, dismissed after less than eight months of employment, appealed a decision regarding compensation for unfair dismissal, specifically challenging the appellate court's ruling that interest on the awarded damages would only begin accruing from the date of the appeal judgment rather than the initial labor court ruling. The Supreme Court rejected the appeal, reasoning that under the applicable Civil Code article, the appellate court retains the discretion to set the starting date for statutory interest on damages, allowing it to deviate from the general rule of accruing interest from the first instance judgment when merely confirming a prior award.

LA COUR DE CASSATION, CHAMBRE SOCIALE,
a rendu l'arrêt suivant :
Attendu, selon l'arrêt attaqué (Paris, 25 novembre 1987) que Melle X... a été embauchée le 2 mai 1983 par la société Cofratel en qualité d'assistante à la direction commerciale et a été licenciée le 22 décembre 1983 ; Attendu que Melle X... fait grief à l'arrêt d'avoir condamné la société Cofratel à lui payer une somme à titre de dommages-intérêts pour licenciement sans cause réelle et sérieuse en disant que cette somme porterait intérêts au taux légal à compter de l'arrêt alors, selon le moyen, que le point de départ des intérêts au taux légal devait être la date du jugement du conseil de prud'hommes condamnant l'employeur et non la date de l'arrêt confirmatif ;
REJETTE le pourvoi ;
