Property Co-Ownership Association v. Real Estate Company Regarding Common Area Parking
Synthèse Legislator
Généré par l'IAThe property co-ownership association appealed a decision regarding common areas, specifically a parking area designated for a projected restaurant building, which the promoting real estate company retained ownership of, as confirmed by a prior ruling. The appellate court correctly determined, based on a sovereign assessment of contractual documents, that the co-owners could not demand the use of this parking area as an indivisible and free common asset, and that the prohibition on commercial activity in the co-ownership regulations applied only to the residential building, not the commercial space in question, leading the high court to reject the appeal.

REJETTE le pourvoi ;
