Motorized Bicycle Operator v. Car Driver (Fault Allocation in Traffic Collision)
Synthèse Legislator
Généré par l'IAIn a nighttime collision within a town, a motorized bicycle collided with an oncoming car whose driver was executing a left turn, resulting in injury to the motorized bicycle operator who then sued for damages. The appellant contended that the appellate court erred by only partially exonerating the car driver from the statutory presumption of liability based on Civil Code Article 1384, allegedly violating specific traffic law articles by not fully accounting for the fault of the injured party. However, the highest court upheld the appellate ruling, reasoning that since the appellate court factually established that the motorized bicycle operator committed faults through reasoning that was not challenged on appeal, the decision was legally justified under the applicable traffic law concerning shared fault, leading to the dismissal of the appeal.

M. Aubouin, président, M. Chabrand, rapporteur, MM.
Attendu, selon l'arrêt infirmatif attaqué (Orléans, 20 janvier 1987), que, de nuit, dans une agglomération, une collision se produisit entre le cyclomoteur de M. Y... et l'automobile de M. Z... qui circulait en sens inverse et avait entrepris de virer à gauche ; que M. Y..., blessé, a assigné M. Z... en réparation de son préjudice ; que la caisse primaire d'assurance maladie du Loir-et-Cher est intervenue à l'instance ; Attendu qu'il est fait grief à l'arrêt d'avoir accordé à M. Y..., pour partie seulement, l'indemnisation de son préjudice, alors qu'en jugeant que les fautes de M. Y... n'exonéraient qu'en partie M. Z... de la présomption de responsabilité pesant sur lui, en application de l'article 1384 du Code civil, la cour d'appel aurait violé les articles 4 et 47 de la loi du 5 juillet 1985 ; Mais attendu que l'arrêt retient, par des motifs non critiqués, que M. Y... avait commis des fautes ;
REJETTE le pourvoi ;
